Xatheryn Wire

Wire Business Terms

Last updated: October 17, 2026

Draft prepared with AI assistance. It has not yet been reviewed by a licensed attorney, and nothing here is legal advice to you or to any customer. It is meant to describe the rules of the paid business version of Xatheryn Wire in plain but binding language.

Wire Business is not open for sign-up yet. These terms apply to a business plan only once you subscribe to one. Until then, the free personal service is covered by the Terms of Service, which do not allow business use.

1. Who these terms are between

Wire Business (the "Business Service") is the paid version of Xatheryn Wire at mail.xatheryn.com, operated by Xatheryn LLC, a North Carolina limited liability company ("Xatheryn," "we," "us"). These Business Terms are a binding agreement between Xatheryn LLC and the business or person who subscribes (the "Customer," "you"). "The Xatheryn Parties" means Xatheryn LLC and its members, managers, officers, employees and agents, and every protection in these terms for Xatheryn covers all of them. Each person who uses a mailbox under your subscription (a "User") must follow these terms and our Privacy Policy. You are responsible for your Users. If you accept these terms for a company, you promise you have the authority to bind it.

The Terms of Service and these Business Terms work together. If they disagree about something in a Business plan, these Business Terms win. Everything in the Terms of Service about scam protection, child safety, reports to law enforcement, and what may never be sent applies to the Business Service too.

2. Accounts, administrators and Users

3. Your domain and your addresses

4. What you may and may not send

Wire Business is for the everyday email of a business: conversation with customers, partners and staff, receipts, confirmations and the other messages people expect from you. Unlike the free service, business use is allowed.

You may not use the Business Service to:

We may read a message or look at sending patterns only to the extent needed to enforce this section, to keep the service safe, and as the law requires.

5. Sending limits and fair use

Business plans include much higher sending limits than the free service, shown on your plan and in your administrator settings. Sending is fair use, not unlimited. We set limits per User and per customer, and may change them, to keep mail deliverable for everyone. A limit exists because other providers judge all of our mail by how our servers behave. We may slow, pause or block sending from a User, a domain or your whole subscription, immediately and without notice, if we see signs of spam, abuse, a compromised account or a sudden jump in volume, or while we look into a report. We will tell an administrator what happened as soon as we reasonably can.

We do not guarantee that any other provider will accept your mail, deliver it, or place it in an inbox rather than a spam folder. We do not control that.

6. Fees, billing and renewal

7. Service level and support

We work to keep the Business Service running and will tell customers about planned downtime when we can. We do not promise a specific uptime and we do not offer service credits unless we agree to them in writing. Mail sent to you while we are down is generally held and retried by the sending provider, but we can't promise that every provider will retry. Support is by email at support@xatheryn.com, and we answer as quickly as we reasonably can.

8. Your content and our access to it

9. Security and your responsibilities

We use reasonable measures to protect your data, and run the service on servers we choose. No system is perfectly secure. You must keep sign-ins and recovery codes secure, remove Users who leave your organization promptly, tell us quickly if you think an account was misused, and keep your own copies of anything important. We are not a backup service.

10. Cancelling, suspension and your data afterwards

11. Ownership

We own the Business Service, our software, our scam-protection engine and the Xatheryn names and logos. You get a limited right to use the service for your business while you are subscribed. You may not copy, resell, sublicense or reverse engineer it. If you give us feedback we may use it freely.

12. Confidentiality

Each side will keep the other's non-public business information private and use it only for this agreement, except where the law requires disclosure or for the reports described in Section 8 of the Terms of Service. Your mail is covered by Section 8 above.

13. Disclaimer of warranties

The Business Service is provided "as is" and "as available," without warranties of any kind, whether express, implied or statutory, including merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the service will be uninterrupted, secure or error-free, that any message will be delivered, received or kept, or that our scam and spam protection will catch every scam or never hold back a real message. Some jurisdictions do not allow these exclusions, so some may not apply to you.

14. Limitation of liability

To the fullest extent permitted by law, none of the Xatheryn Parties will be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or any loss of profits, revenue, business, data or goodwill, arising from or related to the Business Service, any message sent, received, lost, delayed, held back or removed, or the conduct of any User or third party, even if advised of the possibility. The total liability of the Xatheryn Parties for all claims will not exceed the fees you paid us in the twelve months before the claim arose. Nothing here limits liability that the law does not allow to be limited.

15. Indemnification

You agree to defend, indemnify and hold harmless the Xatheryn Parties from any claims, liabilities, damages, losses and expenses, including fines, penalties and reasonable attorneys' fees, arising from your and your Users' use of the Business Service, the mail you send, your domain, your violation of these terms or of any law, or your violation of anyone else's rights.

16. Disputes and governing law

We will first try to resolve any dispute informally: contact us, and give us 30 days. If it isn't resolved, it will be resolved by binding individual arbitration rather than in court, except that either side may bring an individual claim in small claims court if it qualifies, or ask a court to stop misuse of its intellectual property or confidential information. Each side waives any right to a jury trial and to take part in a class, collective or representative action. This agreement is governed by the Federal Arbitration Act and, otherwise, by the laws of the State of North Carolina, without regard to conflict-of-laws rules.

17. Changes to these terms

We may change these Business Terms as the Business Service changes. We will update the date at the top and tell administrators by email. If a change is material and you don't agree, you can cancel before it takes effect. Continuing to use the service afterwards means you accept the change.

18. General

If any part of these terms can't be enforced, the rest still applies. Not enforcing a right isn't a waiver of it. You may not transfer these terms without our written consent; we may transfer them with the business. Neither side is responsible for a delay or failure caused by something outside its reasonable control, except for paying money owed. These Business Terms, the Terms of Service and the Privacy Policy are the whole agreement between you and Xatheryn LLC about the Business Service.
