Terms of Service
Last updated: October 21, 2026
Draft prepared with AI assistance. It has not yet been reviewed by a licensed attorney, and nothing here is legal advice to you or to any user. It is meant to describe the rules of Xatheryn Wire as it works today, in plain but binding language.
1. Agreement to these terms
Xatheryn Wire (the "Service"), at mail.xatheryn.com, is operated by Xatheryn LLC, a North Carolina limited liability company ("Xatheryn," "we," "us"). These Terms of Service ("Terms") are a binding legal agreement between you and Xatheryn LLC. "The Xatheryn Parties" means Xatheryn LLC and its members, managers, officers, employees and agents, and every protection in these Terms for Xatheryn covers all of them. By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. Who can use Xatheryn Wire
You must be at least 15 years old. You must give your real first and last name and your real date of birth when you sign up, and a working email address we can confirm (not a temporary one). We don't ask for ID to create an account. If you link a Xatheryn Connect account that passed Connect's identity check, the name and age confirmed by that check replace what you entered here, and your name can no longer be changed in Xatheryn Wire. Giving false details is a violation of these Terms. You may not create an account if we have previously removed you from the Service or from any other Xatheryn product, and you may not create more than one account to get around a limit or a suspension.
Xatheryn Wire is for personal use. It is not for business, marketing, sales or any other commercial use. For business use, see the Wire Business Terms.
3. Your address and your account
- You choose one address at xatheryn.com. Some names are reserved and can't be taken.
- Addresses belong to Xatheryn and are licensed to you for as long as your account is in good standing. You can't sell, trade or transfer your address.
- If your account is deleted, its address is retired and is never given to anyone else.
- You sign in with a passkey. Keep the devices that hold it secure. You are responsible for everything done through your account, and you must tell us promptly if you think someone else has access.
- If you sign up or sign in with Xatheryn Connect, Connect is how you sign in here and you don't make a Mail passkey. Getting back into your Connect account is handled by Connect; we can't do it for you.
- When you sign up with a passkey we give you a 24-digit recovery code, once. It gets you back in if you lose your passkey. Anyone who has it can sign in as you, so keep it private. We keep only a one-way fingerprint of it and can't show it to you again, but you can make a new one in Settings. If you lose your passkey, your recovery code and access to your recovery email, we can't get you back in.
4. Receiving and sending
Every account can receive email, and can send once you have confirmed your backup email. Sending to other providers is limited, and a verified Xatheryn Connect account gets more: a verified Connect account (one that has passed Connect's identity check) can send more emails a day than an account without one. Your daily limit is shown in Settings. Each person outside Xatheryn that a message goes to counts as one email. Sending is a privilege, not a right, and we may lower or remove it at any time.
- Mail between Xatheryn addresses is free and does not count toward any daily limit. It is still checked for scams and abuse, and we may limit it if it is used to flood or harass.
- Mail to outside addresses has the daily limits above, shown in Settings, which we may change at any time. Outside mail is sent from our own mail servers. We do not guarantee that any other provider will accept, deliver or show your mail in an inbox rather than a spam folder. The limit is per account: what other people send does not use up yours. It resets as your own messages pass 24 hours.
- We may pause or remove your ability to send at any time, including while we look into a report.
5. How you appear to others; the verified check
When your account is linked to Connect you can choose to appear by the verified name on your Connect account, by your Connect username, or by the first and last name you gave at sign-up. Your address is always shown too. Only mail sent from a linked, verified account carries the blue check inside Xatheryn Wire. The check means we confirmed the sender's identity through Connect. It does not mean we vouch for what they say or sell. Using a name that isn't yours is prohibited.
6. What you must not do
You agree not to use the Service, or try to, to:
- run a business, or send marketing, sales or any other commercial email;
- send spam, bulk or unsolicited commercial email, or mail to lists you bought or scraped;
- send phishing, scams or fraud, including fake invoices, fake refunds, fake support numbers, prize or lottery scams, extortion, relationship or investment scams, or anything that tricks people into giving money, codes, passwords or personal information;
- impersonate any person, company or government body, or pretend to be Xatheryn;
- send malware, harmful links, or files designed to steal sign-ins;
- harass, threaten or stalk anyone, or send content that exploits or endangers a minor;
- break any law, including laws on commercial email (such as the CAN-SPAM Act) and privacy;
- get around sending limits, scam protection, suspensions or blocks, or test our scam protection against real people;
- interfere with the Service, access it by automated means we have not allowed, or reverse engineer it.
7. Scam and spam protection
Every message that reaches the Service, and every message sent between Xatheryn addresses, is checked automatically by our own scam protection, which we build and run ourselves. It looks at things like whether the sender proved who they are, look-alike names and links, phone numbers, threats and pressure, and known scam patterns, and it compares mail against genuine mail from the same senders.
What happens to a message:
- Scam. When our system decides a message is a scam, it is kept out of your inbox and out of search. It is held on its own Scams page (the Scams line under Updates), where you can read it as plain text, with links, pictures and attachments turned off. If we got it wrong, choose "Not a scam" to move it back. Scams are deleted after 30 days, and we may keep a copy longer as evidence (Section 8). A message you report for child safety is never shown on that page.
- Suspicious. The message stays in your mailbox with a red flag and a warning, and its links are turned off.
- Spam. Mail you report as spam, and later mail from that sender, goes to your Spam tray and is deleted after 30 days.
No filter is perfect. Our system will sometimes miss a scam, and will sometimes flag or remove a real message. If you find a real message on the Scams page, you can move it back yourself. If you think we removed a real message and can't find it there, contact us and we will look at it. We may return it to you, but we don't have to. You remain responsible for checking anything you act on, especially requests for money, codes, passwords or personal details. We are not liable for anything that gets through, or for a real message that we held back or removed.
When you or other users report a message, the addresses, domains, links and phone numbers in it are added to a shared list that protects every Xatheryn user, including Connect. We also run addresses that exist only to catch scam mail.
8. Scams sent from Xatheryn accounts; reports to law enforcement
Everyone who can send from Xatheryn Wire has confirmed a backup email, and every account that carries the blue check has had its identity confirmed through Connect. If a person on our team confirms that an account sent a scam, fraud, extortion, or mail that endangers a child:
- we stop the account from sending, and may suspend it and its linked Connect account;
- we keep the related messages and records as evidence, even past our normal deletion times; and
- we may report the account to law enforcement and the relevant authorities (for example the FBI's IC3, the FTC, NCMEC, or local police). A report can include the sender's identity details held by Connect, such as their legal name and date of birth, and the messages involved.
Automated flags alone never trigger a report to law enforcement. A person always reviews first. We also respond to valid legal requests, such as subpoenas and court orders. By linking a Connect account to send mail, you agree to this.
Child safety. You can report any email with Report a child safety concern. The email is removed from your mailbox and a copy is locked away for our safety team, even if the email or either account is later deleted. We report apparent child sexual abuse material, and attempts to lure or extort a child, to the National Center for Missing & Exploited Children (NCMEC), as federal law requires. We keep what we report for at least one year.
9. Storage
Each account has a storage limit, shown in Settings. When you're over it, new mail may be refused and bounced to the sender. You're responsible for keeping copies of anything important. We are not a backup service.
10. Your content
You own the mail you write. You give us permission to store, process, scan, deliver and show it only as needed to run the Service, including the scam checks in Section 7. We don't sell your mail or use it for advertising.
11. Advertising
Pages you see while signed out, such as the sign-up and sign-in pages, may show ads from Google AdSense. Signed-in pages, including your inbox and every message, never show ads. We never use the content of your mail to choose ads.
12. Other Xatheryn products
Linking to Xatheryn Connect is optional and is covered by Connect's own Terms and Privacy Policy. Each Xatheryn product has its own terms, and a subscription or benefit in one product does not carry over to another unless that product says so.
13. Ending your account
You can delete your account at any time in Settings. Deletion removes your mail and cannot be undone, except for records we must keep under Section 8 or the law. We may suspend or delete any account that breaks these Terms or harms other people or the Service, or for any other reason at our discretion, with or without notice. We may also change or stop offering the Service.
14. Disclaimer of warranties
The Service is provided "as is" and "as available," without warranties of any kind, whether express, implied or statutory, including merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the Service will be uninterrupted, secure or error-free, that any message will be delivered, received or kept, or that our scam and spam protection will catch every scam or never flag a real message. Some jurisdictions do not allow these exclusions, so some may not apply to you.
15. Limitation of liability
To the fullest extent permitted by law, none of the Xatheryn Parties will be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or any loss of profits, revenue, data, goodwill or other intangible losses, arising from or related to the Service, any message sent, received, lost, delayed, flagged or removed, any scam or fraud by any person, or any conduct of any user or third party, even if advised of the possibility. Our total liability for all claims will not exceed the greater of the amount you paid us in the twelve months before the claim arose, or one hundred U.S. dollars ($100). Some jurisdictions do not allow these limitations, so some may not apply to you.
16. Indemnification
You agree to defend, indemnify and hold harmless the Xatheryn Parties from any claims, liabilities, damages, losses and expenses, including fines, penalties and reasonable attorneys' fees, arising from your use of the Service, the mail you send, your violation of these Terms or of any law, or your violation of anyone else's rights.
17. Dispute resolution; arbitration; class action waiver
Please read this section carefully; it affects your legal rights. You and Xatheryn LLC agree to try first to resolve any dispute informally by contacting us. If it isn't resolved within 30 days, it will be resolved by binding individual arbitration rather than in court, except that either side may bring an individual claim in small claims court if it qualifies. You and Xatheryn LLC each waive any right to a jury trial and to take part in a class, collective or representative action. This agreement is governed by the Federal Arbitration Act. If applicable law doesn't allow any part of this section to be enforced, only that part won't apply.
18. Governing law
These Terms are governed by the laws of the State of North Carolina, where Xatheryn LLC is organized, without regard to conflict-of-laws rules, except where your state's consumer-protection law requires otherwise.
19. Changes to these Terms
We may change these Terms as the Service changes. We will update the date at the top. When a change is material, we'll ask you to accept the new Terms before you continue using the Service.
20. General
If any part of these Terms can't be enforced, the rest still applies. Not enforcing a right isn't a waiver of it. You may not transfer these Terms; we may. These Terms and the Privacy Policy are the whole agreement between you and Xatheryn LLC about the Service.
